Last Updated: October 9, 2026

ACCEPTANCE OF THESE TERMS

Welcome to Designed to Thrive Creative, LLC.

These Terms of Use (“Terms”) govern your access to and use of the websites, publications, communities, products, memberships, content, events, and services owned or operated by Designed to Thrive Creative, LLC (“Company,” “we,” “us,” or “our”).

These Terms apply to all Company brands, platforms, and offerings, including, without limitation:

• The Wonder Habit®

• Frolic & Forage Society

• Our Substack publications and paid subscriptions

• Our websites and online stores

• Email newsletters and other digital communications

• Digital products, downloads, templates, printables, and creative resources

• Courses, workshops, educational programs, and events

• Memberships, communities, and interactive online spaces

• Any future brands, publications, platforms, products, or services owned or operated by Designed to Thrive Creative, LLC

Collectively, these are referred to as the “Services.”

By accessing, purchasing, subscribing to, downloading, registering for, participating in, or otherwise using the Services, you agree to be bound by these Terms and any additional policies or agreements expressly applicable to the Services you use.

If you do not agree to these Terms, you should not access or use the Services.

Certain brands, products, communities, or events may be subject to additional policies, licenses, waivers, or participation requirements. Where a specific agreement conflicts with these general Terms, the more specific agreement will govern that particular Service to the extent of the conflict.

SECTION 1. COMPANY IDENTITY & INDEPENDENT STATUS

Designed to Thrive Creative, LLC is an independent creative business that develops and operates publications, educational resources, creative communities, digital products, and related services.

The Company's brands and publications are operated under the ownership or authority of Designed to Thrive Creative, LLC.

Except where expressly authorized in writing by the Company, no subscriber, customer, member, participant, organizer, contributor, or community host is an employee, agent, partner, affiliate, franchisee, or authorized representative of Designed to Thrive Creative, LLC.

Nothing in these Terms creates an employment, agency, partnership, joint venture, franchise, or other legal relationship between you and the Company.

You may not represent that you have authority to act for, bind, enter into agreements for, or incur obligations on behalf of the Company without its prior written authorization.

SECTION 2. ELIGIBILITY & ACCOUNT RESPONSIBILITY

The Services are generally intended for individuals 18 years of age or older, unless a particular Service expressly states otherwise.

By making a purchase, creating a paid subscription, registering for an event, or entering into an agreement with the Company, you represent that you are legally capable of entering into that transaction.

If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for activities occurring under your account.

You agree to provide accurate information when registering, subscribing, purchasing, or participating in the Services.

We may suspend, restrict, or terminate access where we reasonably believe an account has been used fraudulently, has violated these Terms, or poses a risk to the Company, its Services, or other participants.

SECTION 3. INTELLECTUAL PROPERTY & OWNERSHIP

Unless otherwise stated, the original content, publications, written materials, artwork, illustrations, photographs, designs, logos, trademarks, frameworks, creative resources, courses, recordings, digital products, and other intellectual property made available through the Services are owned by Designed to Thrive Creative, LLC or used with appropriate permission.

These materials are protected by applicable copyright, trademark, and other intellectual property laws.

The names, identities, branding, and associated creative materials of the Company's brands, including The Wonder Habit and Frolic & Forage Society, may not be used in a manner that falsely implies affiliation, sponsorship, endorsement, or authorization.

Except as expressly permitted by applicable law, these Terms, an applicable product license, or written authorization from the Company, you may not reproduce, redistribute, sell, sublicense, republish, commercially exploit, or create products for distribution using Company-owned materials.

You may share links to publicly accessible Company publications and content, and you may quote limited excerpts where permitted by applicable law, with appropriate attribution.

All rights not expressly granted are reserved.

SECTION 4. DIGITAL PRODUCTS & LICENSED RESOURCES

Unless otherwise expressly stated, digital products and resources made available through the Services are licensed, not sold.

This includes downloadable guides, workbooks, templates, planners, printables, artwork, digital tools, educational materials, recordings, and similar resources.

Unless a product expressly includes broader usage rights, purchasing or downloading a resource grants you a limited, non-exclusive, non-transferable license for personal, non-commercial use.

You may not sell, redistribute, publicly upload, share purchased files with others, sublicense, or commercially exploit digital products without appropriate authorization.

Some products may include separate licenses permitting commercial, professional, educational, organizational, or community use. Those permissions will be described in the applicable product listing, license, or purchase agreement.

Where a specific product license provides additional rights, that license governs the permitted use of that product.

Certain Frolic & Forage Society resources may be reproduced in reasonable quantities for independently organized, non-commercial gatherings, subject to the applicable Society policies and resource licenses.

SECTION 5. PUBLICATIONS, NEWSLETTERS & SUBSCRIPTIONS

The Company publishes original writing, commentary, educational content, creative resources, and other materials through its websites, Substack publications, email newsletters, and additional distribution platforms.

Free subscriptions may provide access to selected publicly available or subscriber-only content.

Paid subscriptions may provide access to additional publications, resources, community features, recordings, or other benefits as described at the time of subscription.

The Company reserves the right to modify publication schedules, editorial direction, content formats, membership features, and future offerings.

We do not guarantee any specific frequency of publication, quantity of content, or continuation of a particular feature unless expressly stated as part of a paid offering.

Subscriptions managed through third-party platforms are also subject to those platforms' applicable terms, billing procedures, and account policies.

SECTION 6. PURCHASES, PAYMENTS, RENEWALS & REFUNDS

The Company may offer paid subscriptions, memberships, digital products, courses, workshops, event registrations, physical merchandise, and other products or services.

Purchases and subscriptions may be processed through third-party platforms, payment processors, or merchants of record.

The identity of the seller or merchant of record, applicable taxes, payment methods, billing terms, and checkout conditions may vary depending on the product and platform used.

Recurring subscriptions automatically renew at the billing interval disclosed at purchase unless canceled before the next renewal.

By purchasing a recurring subscription, you authorize the applicable payment provider to process recurring charges according to the disclosed subscription terms.

You may cancel a recurring subscription through the platform where it was purchased, subject to the applicable cancellation procedures.

Unless otherwise stated or required by applicable law, cancellation takes effect at the end of the current billing period.

Refund eligibility depends on the type of purchase, the applicable Return & Refund Policy, the terms presented at checkout, the policies of the merchant of record, and any mandatory consumer protections.

Because digital products may be delivered immediately, some purchases may be nonrefundable where permitted by law and where the applicable disclosures and consent requirements have been satisfied.

If you experience a billing or access issue, we encourage you to contact us or the applicable payment provider so the matter can be reviewed.

Nothing in these Terms limits any statutory right to a refund, cancellation, payment dispute, or other consumer remedy.

The Company may change prices, introduce new products, modify subscriptions, or discontinue offerings. Changes to existing recurring subscriptions will be handled in accordance with applicable laws, platform requirements, and any required notice or consent.

SECTION 7. COURSES, WORKSHOPS & EDUCATIONAL CONTENT

The Company may offer courses, workshops, creative programs, live sessions, recorded instruction, and other educational experiences.

These offerings are intended for informational, educational, and creative purposes.

Participation does not guarantee any particular personal, professional, creative, financial, or other outcome.

You are responsible for evaluating whether an activity, technique, recommendation, or resource is appropriate for your circumstances.

Access periods, attendance requirements, recordings, cancellations, and any additional participation conditions will be communicated through the applicable offering or registration materials.

Unless expressly authorized, course recordings, teaching materials, workshop resources, and related content may not be redistributed, resold, or used to develop competing commercial products.

SECTION 8. NO PROFESSIONAL ADVICE

The Company's content and Services are provided for educational, informational, creative, recreational, and general personal-development purposes.

Nothing provided through the Services constitutes medical, psychological, mental health, legal, financial, tax, nutritional, or other regulated professional advice.

The Company does not establish a professional-client relationship through its publications, courses, workshops, products, or community interactions.

You are responsible for your own decisions and for seeking appropriate professional advice when needed.

Any personal experiences, observations, creative practices, or perspectives shared through Company publications represent their stated context and should not be interpreted as individualized professional guidance.

SECTION 9. ACCURACY OF INFORMATION

We make reasonable efforts to provide accurate and current information throughout our Services. However, we do not guarantee that all information will be complete, accurate, or up to date.

We reserve the right to correct errors, update information, and modify or remove content as appropriate.

Information provided through our Services is for general educational and informational purposes and should not be relied upon as a substitute for appropriate professional advice.

SECTION 10. PARTICIPATION, ACTIVITIES & ASSUMPTION OF RISK

Participation in creative projects, workshops, events, gatherings, challenges, recreational activities, and community experiences is voluntary.

Certain activities may involve physical materials, tools, movement, travel, public venues, or interactions with other individuals.

You are responsible for exercising reasonable judgment, following appropriate safety precautions, and determining whether an activity is suitable for your abilities, experience, environment, and circumstances.

You are also responsible for any adaptations or modifications you make to activities or resources.

To the fullest extent permitted by applicable law, you acknowledge and assume the ordinary and reasonably foreseeable risks associated with your voluntary participation in activities you choose to undertake.

Nothing in this Section excludes liability that cannot lawfully be excluded.

SECTION 11. COMMUNITIES & INDEPENDENT GATHERINGS

The Company may operate or support online communities, member spaces, discussion forums, directories, gatherings, and other opportunities for connection.

Certain communities, including the Frolic & Forage Society, may encourage participants to organize independent local or virtual gatherings.

Unless an event or activity is expressly identified by the Company as officially organized or sponsored, participant-organized gatherings, groups, meetings, and online spaces are independent activities.

The Company does not organize, administer, supervise, insure, inspect, or assume operational responsibility for independently organized gatherings.

Participants and organizers are responsible for their own activities, communications, venues, safety arrangements, legal compliance, and interactions with others.

Listing an independent gathering in a Company directory, calendar, publication, or community resource does not constitute verification, sponsorship, endorsement, or approval.

The Frolic & Forage Society is additionally governed by its applicable Community Guidelines, Brand Use Policy, and independent troop and gathering requirements.

Permission to use Society names or materials does not create an official chapter, franchise, agency, or representative relationship.

The Company may withdraw permissions to use its branding or remove directory listings where appropriate under the applicable policies.

Official Company events may require separate registration agreements, waivers, or other participation terms.

SECTION 12. COMMUNITY CONDUCT & MODERATION

When participating in Company-operated communities, discussions, events, or interactive spaces, you agree to conduct yourself respectfully and lawfully.

You may not use the Services to harass, threaten, discriminate against, exploit, defraud, impersonate, or abuse others.

You may not post unlawful content, infringe intellectual property or privacy rights, distribute spam or malicious software, or materially disrupt the operation of the Services.

The Company reserves the right, but does not undertake a general obligation, to moderate Company-controlled spaces, remove content, restrict participation, or suspend access when reasonably necessary to protect the Services, participants, or Company interests.

Additional community-specific standards may apply.

The Company does not control independently operated social media groups, private communications, or other third-party spaces merely because participants share an interest in one of its brands.

SECTION 13. USER-SUBMITTED CONTENT

You retain ownership of original photographs, artwork, writing, comments, designs, videos, and other materials you submit through the Services (“User Content”).

By submitting User Content to a Company-operated interactive Service, you grant the Company a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, and distribute that content as reasonably necessary to operate and provide the Service.

Where you voluntarily submit content specifically for publication, a community feature, promotional consideration, or another identified purpose, you also authorize its use for that stated purpose, subject to any additional permissions or restrictions communicated at submission.

The Company will not treat private correspondence or unpublished submissions as a general authorization for unrestricted public promotional use.

You represent that you have the rights necessary to submit your content and that doing so does not infringe the rights of others.

The Company may decline, remove, or discontinue displaying User Content in Company-controlled spaces.

Content submitted through third-party platforms may also be governed by those platforms' terms.

SECTION 14. THIRD-PARTY PLATFORMS & EXTERNAL LINKS

The Services may use or link to third-party platforms, including publishing services, payment processors, digital product delivery systems, email providers, event platforms, and other technology services.

These providers operate under their own terms, privacy policies, and service conditions.

The Company is not responsible for the independent practices, content, security, availability, or actions of third-party services outside its control.

Links to external websites or resources do not necessarily constitute endorsement.

Where a third-party provider acts as the merchant of record or contractual seller for a transaction, its applicable checkout and consumer terms may govern that transaction.

SECTION 15. AFFILIATE LINKS & RECOMMENDATIONS

Our websites, publications, newsletters, and other communications may contain affiliate links or recommendations for third-party products and services.

We may receive a commission or other compensation when you make a purchase through certain links, at no additional cost to you.

We disclose material affiliate relationships as required by applicable law. We are not responsible for the products, services, policies, or practices of independent third-party sellers.

SECTION 16. PRIVACY & COMMUNICATIONS

The Company's collection, use, storage, and handling of personal information are described in its Privacy Policy.

By subscribing to newsletters or other communications, you agree to receive the communications for which you have registered, subject to applicable law and your communication preferences.

You may unsubscribe from marketing emails using the unsubscribe instructions provided in those messages.

Certain transactional or administrative communications may still be necessary to fulfill purchases, maintain accounts, or provide important information about the Services.

SECTION 17. DISCLAIMER OF WARRANTIES

To the fullest extent permitted by applicable law, the Services are provided on an “as is” and “as available” basis.

The Company makes no guarantee that its websites, publications, products, community spaces, or digital services will be uninterrupted, error-free, continuously available, or suitable for every user's individual needs.

The Company does not guarantee particular creative, personal, educational, business, or financial results from using its content or Services.

Nothing in these Terms excludes warranties or consumer rights that cannot lawfully be excluded.

SECTION 18. LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Designed to Thrive Creative, LLC, D. Michele Perry, and their respective owners, officers, employees, contractors, licensors, successors, and assigns (collectively, the “Protected Parties”) shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from or relating to the Services.

This includes, where legally permissible, lost profits, lost revenue, lost data, business interruption, reputational harm, or other consequential losses.

To the fullest extent permitted by applicable law, the total cumulative liability of the Protected Parties arising out of or relating to the Services or these Terms shall not exceed the greater of:

(a) the total amount paid by you to Designed to Thrive Creative, LLC for the applicable Services during the twelve months preceding the event giving rise to the claim; or

(b) one hundred U.S. dollars (US $100).

Nothing in these Terms excludes or limits liability for fraud, willful misconduct, gross negligence, personal injury, statutory consumer rights, or other matters to the extent such liability cannot legally be excluded or limited.

SECTION 19. INDEMNIFICATION

To the fullest extent permitted by applicable law, you agree to defend, indemnify, and hold harmless the Protected Parties against third-party claims, liabilities, losses, damages, and reasonable legal expenses arising from:

• Your unlawful use or misuse of the Services

• Your material violation of these Terms

• Your infringement of another person's intellectual property, privacy, or other legal rights

• User Content you submit in violation of these Terms

• Your unauthorized representation of or commercial activity on behalf of the Company

• Your organization or operation of independent gatherings or communities, to the extent a claim results from your conduct or legal responsibilities

The Company reserves the right to participate in or assume control of the defense of a claim subject to indemnification, where permitted by law.

Nothing in this Section requires indemnification for losses caused by the Company's own unlawful conduct or where indemnification is otherwise prohibited.

SECTION 20. CHANGES, AVAILABILITY & TERMINATION

The Company may update, modify, suspend, replace, or discontinue Services, products, features, publications, or offerings.

We may also restrict or terminate access where reasonably necessary because of violations of these Terms, security concerns, unlawful activity, or discontinuation of a Service.

Any changes affecting existing paid commitments will remain subject to applicable purchase agreements, refund policies, and consumer protection laws.

Termination of access does not transfer ownership of Company intellectual property or authorize continued use of materials beyond an applicable license.

SECTION 21. GOVERNING LAW & DISPUTES

These Terms shall be governed by the laws of the State of Florida, United States, without regard to conflict-of-laws principles, except where mandatory laws of another jurisdiction apply.

To the extent permitted by applicable law, legal proceedings arising from these Terms or the Services shall be brought in the state or federal courts located in Duval County, Florida.

Nothing in this Section deprives consumers of mandatory rights, protections, or remedies available under applicable law in their place of residence.

SECTION 22. CHANGES TO THESE TERMS

The Company may revise these Terms to reflect changes in its business operations, products, platforms, legal obligations, or Services.

The updated version will be published with a revised effective or last-updated date.

Where required by law, or where material changes affect existing contractual rights, we will provide appropriate notice and obtain consent when necessary.

Continued use of the Services after revised Terms become effective may constitute acceptance where permitted by applicable law.

SECTION 23. SEVERABILITY & ENTIRE AGREEMENT

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in effect to the fullest extent permitted by law.

These Terms, together with the applicable Privacy Policy, Return & Refund Policy, product licenses, community policies, event agreements, and other expressly incorporated agreements, constitute the agreement governing your use of the relevant Services.

No failure by the Company to enforce a provision constitutes a permanent waiver of that provision.
